Introduction

Welcome to FIM-MOTO.TV! These Terms and Conditions govern your use of our OTT Platform (managed by ORIGINS DIGITAL) and any related services, features, or content (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and Conditions, as well as any additional terms and conditions that we may provide to you in connection with the Service.

Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction to use the Service. By accessing or using the Service, you represent and warrant that you meet these eligibility requirements and that you have the right, authority, and capacity to enter into these Terms and Conditions.

Registration and Subscription

To use our platform, you must register an account with us. You must provide accurate and complete information when registering and keep your account information up to date. To access our premium content, you must purchase a subscription. The subscription fee is non-refundable and is subject to change at our discretion. We reserve the right to suspend or terminate your account and subscription at any time without notice for any reason, including but not limited to violation of these terms and conditions.

Payment

Your payments are made through Stripe which is payment-processing software integrated in our OTT platform making online payments possible directly on FIM-MOTO.TV. It allows safe and efficient processing of funds via credit card and transfers those funds to FIM accounts. Stripes software includes both a payment processing platform, as well as a credit card payment gateway.

Content and Intellectual Property

The Service may include various types of content, including but not limited to text, graphics, images, audio, video, and software (collectively, “Content”). The Content is owned by or licensed to us, and is protected by intellectual property laws, including copyright, trademark, and patent laws.

You hereby acknowledge that the FIM Intellectual Property rights, including but not limited to all its trademarks, trade business names, names of FIM competitions as provided in article 3 of the FIM Statutes and article 30.1 of the FIM Sporting Code including the titles “World Championship”, “Grand Prix” and Prize events (“World Cup”), domain names used in relation with the FIM competitions or activities, patents, copyrights, FIM databases, archives, images, videos and any FIM information provided to you in relation to the FIM competitions or activities, constitutes an exclusive property of the FIM and/or that the FIM holds and exclusive title for their usage. You shall consequently under no circumstances make any use of such rights or the FIM names or denominations in a separate or combined manner, either during the duration of the Service or following its termination, without the FIM’s prior written approval.

You may use the Service and the Content only for your own personal, non-commercial use, and you may not copy, modify, distribute, display, transmit, or sell any Content without our prior written consent. You may not use the Service or the Content in any manner that violates any applicable laws, regulations, or third-party rights.

Privacy

All personal data stored in this OTT platform or hosted by ORIGINS DIGITAL is processed in accordance with the applicable data protection laws and will be processed solely in connection with the implementation Service and in accordance with our Privacy Policy.

User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms and Conditions. You may not use the Service to:

Engage in any activity that is illegal, harmful, or oﬀensive;
Violate any applicable laws or regulations;
Infringe upon the intellectual property rights or privacy rights of others;
Transmit any viruses, malware, or other harmful code;
Collect or store any personally identifiable information of other users; or
Interfere with or disrupt the Service or any related servers, networks, or systems.

Disclaimers and Limitations of Liability

The Service is provided “as is” and “as available,” without any warranties or representations of any kind, either express or implied. We do not warrant that the Service will be uninterrupted or error- free, or that any defects will be corrected. We do not assume any responsibility for the accuracy, completeness, reliability, or usefulness of any Content.

In no event shall we be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with the Service or these Terms and Conditions, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold us and our aﬃliates, oﬃcers, directors, employees, agents, and licensors harmless from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms and Conditions.

Modification and Termination

We reserve the right to modify these Terms and Conditions at any time, in our sole discretion. If we make any material changes to these Terms and Conditions, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after such notification constitutes your acceptance of the modified Terms and Conditions.

We may terminate your access to the Service at any time, for any reason, without notice or liability. All provisions of these Terms and Conditions that by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Miscellaneous

These Terms and Conditions shall be governed and construed in accordance with the laws of Switzerland.

Any dispute controversy or claim arising out of, or in relation to, these Terms and Conditions, including the validity, invalidity, breach, or termination thereof, which cannot be settled amicably between the Parties shall be exclusively submitted to the courts of the Vaud canton.

These Terms and Conditions do not limit any consumer protection rights, you are entitled to under the mandatory laws of your country of residence.
